Certificate Program in Commercial Conciliation

Mediation or Conciliation has developed into a mainstream dispute resolution process for commercial disputes. It helps to resolve disputes satisfying the needs and interests of the parties and help to build great relationships.
In India, settlements made under conciliation is considered equivalent to an arbitral award, providing easy enforcement for the settlements made in conciliation. Apart from the Conciliator, the Conciliation expert/consultant can play an active and crucial role in coaching the client and assisting the process by a problem-solving approach, usually in a collaborative and constructive manner, towards a consensus-building, satisfying and value-added outcome.
The Certificate Program in Commercial Conciliation (CPCC) at IIAM, is a 30 hour (3-day) program, which offers the opportunity to understand the various stages of conflict and various dispute resolution methods. It covers the types, styles and strategies of negotiation, the law governing conciliation, and the rules of conciliation. It will also cover the types of disputes that could be conciliated under the laws of India and the science and art of conciliation – basic stages of conciliation process, including the pre-conciliation stage, opening stage, information gathering, agenda setting, caucus sessions, resolution and settlement agreement. The program also covers various roles and techniques, adopted by the conciliation advocate, including case assessment. It will also cover the techniques and legal requirements of writing settlement agreement and the enforceability of such agreements. The course provides participants with the opportunity to practice this structured dispute resolution process through a series of interactive presentations, role play simulations, real life case studies and discussion groups.
On successful completion of the Program, the candidate will be eligible to be accredited as an IIAM Accredited Mediation Advocate under the relevant Qualifying Assessment Program. For enabling disputing parties to identify the appropriate advocate/advisor to advise and represent them in mediations/conciliations, they would be enlisted under the PeaceGate App , subject to the norms of enlistment, thereby enlarging the scope of practice throughout India.
